تجزیه و تحلیل گفتمان دادگاه براساس اصول همکاری گرایس از دیدگاه زبان‌شناسی حقوقی

چکیده

این پژوهش به تجزیه و تحلیل گفتمان دادگاه حوادث تروریستی توسط متهمان داعشی در حمله به مجلس شورای اسلامی و حرم مطهر امام خمینی (ره) ۱۷خرداد ماه ۱۳۹۶، براساس اصول چهارگانه همکاری گرایس (1975) از دیدگاه زبان‌شناسی حقوقی پرداخته است. اصول همکاری در مکالمات دادگاه در اصول کیفیت، کمیت، ارتباط و شیوه/ سبک دسته‌بندی شد. روش پژوهش به‌صورت توصیفی و تجزیه و تحلیل داده‌های آرشیو جلسات دادرسی دادگاه از داده‌ها از برنامه 20:30 صداوسیما و درگاه آپارات جمع‌آوری شد. داده‌ها شامل 50 فایل تصویری 10دقیقه‌ای از جریان دادرسی بود و به‌صورت نمونه‌گیریِ دردسترس انتخاب شدند. سپس جملات قضات، معاونان دادستان، خانوادۀ شهدا و و متهمان در اصول چهارگانه دسته‌بندی شدند و موارد پیروی و تخطی از اصول همکاری گرایس شمارش و ضبط شد. نتایج نشان داد که پیروی از اصل کیفیت در پایین‌ترین حد خود نشان‌دهندۀ موارد فراوان ضدونقیض و اطلاعات غلط در مکالمات طرفین بوده است. اصل ارتباط و شیوه/سبک از تخطی کمتر برخوردار بوده است که نشان می‌دهد قضات و متهمان در این خصوص کمتر دچار انحراف شده‌اند. در مجموع باید نتیجه گرفت که قضات، معاون دادستان و خانوادۀ شهدا بیشتر از متهمان از اصول چهار گانه گرایس پیروی کرده اند که این پیروی بیشتر در اصل ارتباط بوده‌است و بالاترین تخطی مربوط به متهمان بوده که در اصل کمیت رخ داده است.

چکیده [English]

The present study examines the impact of the usage of the principles of Grice’s (1975) cooperative principles of Quality, Quantity, Relevance, and Manner in legal discourse based on the observance of such rules and principles of conversation in defense sessions of ISIS defendants attacking the Islamic Consultative Assembly and Imam Khomeini Holy Shrine. Data of the present descriptive-qualitative study was collected from fifty 10-minute video files from the 20:30 TV program and Aparat Web site in various defense sessions of the defendants of attacking the Islamic Consultative Assembly and the Holy Shrine of Imam Khomeini. Findings showed that Gricean maxims were violated in terms of Quantity but the court interlocutors followed Relevance maxim in the court exchanges. The lowest frequency was observed in the Quality maxim since the speakers avoid appropriate and true conversations in the court. Results also revealed that defendants violated all the maxims compared with judges and martyrs' families.
